TAFE: Accident make-up pay

Key points

  • An employee is entitled to access unused sick leave credits while a WorkCover claim is being determined.

  • On the insurers acceptance of the claim, sick leave taken shall be recredited to the employee.

  • An employee is entitled to 52 weeks make-up pay from the employer for a continuous or aggregate period of injury or incapacity.

  • The employees rate of pay for up to 52 weeks shall be the employees actual rate of pay at the time of injury.

  • Sick leave with pay cannot be paid while an employee is in receipt of compensation payments under WorkCover.

  • After 52 weeks, compensation payments are a percentage of pre-injury earnings as per the Accident Compensation Act 1995 (Vic).
